BOOKING TERMS & CONDITIONS

Bornwild Pty Ltd trading as Bornwild requires each Team Player to read and sign the bottom of each page acknowledging that they have read, understood & accept the Terms & Conditions as set out below:

DOCUMENTATION

Each Team Player acknowledges that he/she is responsible for obtaining all the necessary documentation including a valid passport and visa's to participate in the adventure.

INSURANCE

BORWILD requires each Team Player to obtain comprehensive travel insurance covering cancellation, curtailment, medical expenses, emergency travel, personal accident, casualty evacuation, compensation for loss or damage to property or possession and public liability insurance. Each Team Player acknowledges that it is their personal responsibility to take out insurance at the time of paying the deposit. The cost of insurance is not included in the price quoted. Details of a recommended insurer are available on request.

Each Team Player must provide Bornwild with a certificate of currency (as evidence of a current insurance policy valid for a period of 12 months) when paying the final installment. If a certificate of currency is not provided 24 hours before departure the Team Player will NOT be allowed to travel with the tour.

LEGAL COMPLIANCE

Each Team Player agrees to comply with all legislation, customs, immigration and general laws and regulations of the countries through which the Adventure will pass.

HEALTH & FITNESS

Each Team Player confirms they have sought medical advice informing their medical practitioner of the destination and requirements of the adventure and believe they are in good health. Each Team Player confirms they have completed the Participation Form accurately and agrees to immediately inform BORNWILD if there are any changes.

Each Team Player is responsible for ensuring they provide all their own prescribed medical needs and that they have a supply in accordance with the adventure dates. BORWILD cannot guarantee that prescription medication will be available in Malawi and it is the Team Player's responsibility to ensure they are in possession of sufficient supplies. Further, the Team Player must have a letter from their medical doctor stating the medication prescribed; the amount of medication required and for what purpose - this may be required at customs in certain foreign countries.

FEES & OTHER CHARGES

The price quoted includes: internal travel when part of the Adventure, administration and all special equipment supplies that may be required during the Adventure. The price quoted does NOT include: payment of inoculation costs, passports, visas, airport taxes and any other incidentals not specified. Each Team Player must provide his/her own personal equipment and clothing as detailed in the Adventure information kit. Adventure costs may be subject to fluctuation. BORNWILD reserves the right to increase the advertised price without notice at any time up to and including the day of departure in the event of exchange rate fluctuations, changes in airport charges, increases in airfares or fuel costs or other service fees.

All payments must be made by cash, TFT or bank cheque - no personal cheques are accepted.

CANCELLATION

Each Team Player acknowledges reading the cancellation and refund policy.

BORNWILD'S REFUND POLICY

The non refundable deposit may be applied to any future trips planned with BORNWILD.

The Team Player is solely responsible for all travel fees, charges, expenses or penalties that may result from any cancellation of or amendment to the Team Player's placement.

CHANGES TO DESTINATION, ITINERARY ETC

Where circumstances arise that in BORNWILD's opinion it is necessary to change the destination or departure date and or change the itinerary including routes, length of Adventures, number of people in Adventure groups, activities to be completed at various destinations, then BORNWILD is entitled to make any such changes without prior written notification of consultation with the Adventure participant.

TRANSFERABILITY

This Agreement is between BORNWILD and the Participant (Team Player) and or their parent or legal guardian who will not assign the benefit of this Agreement without prior written consent of BORNWILD.

EMAIL, FAX & OTHER FORMS OF ELECTORIC COMMUNICATION

When you have requested the itinerary or other flight documentation to be sent to you my email, fax or other forms of electronic communications failure to receive it does not constitute an unsuccessful booking. A booking is deemed successful and complete after payment has been made and approved. In the event of any dispute, the booking in the BORNWILD database is the primary record of carriage and will prevail.

BORNWILD is not responsible for the delivery of electronic communications.

DISCLAIMER & INDEMNITY

By signing this Agreement together with the Bornwild Participation Adventure Form, each Participant and where the Participant is under 18 years his/her parent or legal guardian agrees to be bound by the conditions set out in both these documents. Where the Participant is less than 18 years of age, the applicant and parents and or legal guardian must sign the forms.

The Team Player indemnifies BORNWILD its directors, employees and volunteers against any liability that may arise from the Team Player inaccurately informing BORNWILD of any medical conditions, poor health or failing to arrange all necessary documentation including visa's or failing to obtain all necessary inoculations.

Except where to do so would cause a breach of Trade Practices Legislation or cause any part of these Terms to be void or unenforceable BORNWILD excludes all conditions and warranties implied into these Terms; to the full extent permissible by law, BORWILD is not liable to the Participant or anyone else for any loss or damage however caused (including negligence).

Without limiting the general disclaimer, BORNWILD makes not warranty as to the completeness or accuracy of any material or as to its fitness for particular use. BORNWILD is not liable to anyone else if the information on this website contains errors or is not up to date or if interference with or damage to your computer system occurs in connection with use of this website or external sites.
